Our estimated time required to complete the website project is 12 weeks. Our estimated time to complete the brand guide project is 2 weeks. We will commence all work after we have received a signed contract and the 50% non-refundable deposit is received. Please keep in mind that we rely on you and your team to provide all necessary assets, revisions and approvals in order to keep the projects within their projected timelines. Upon a signed contract, Clever will provide a project timeline with milestones and deliverables to keep the project on schedule. 

Clever will provide an initial website mockup of the home page and one sub page for review by the Client. Client will have up to three sets of revisions to the mock ups. Client will sign off on the approval of the mock ups in order to move the project into the website development phase. Any changes made to the design after approval of the mock ups will be billed at the hourly rate of $70/hour for website design services at a minimum of one quarter hour. Once in the website development phase, Clever will provide a live link to the Client to view the progress of the site build out. Clever will notify the client when milestones have been reached in the website development for review. At this time, the Client will have up to three sets of revisions to the website development. Any changes beyond the first three sets of revisions will be billed at the hourly rate of $75/hour for website development services at a minimum of one quarter hour increments. 

Clever provides a seven (7) day window from the date of your website launch for error review and correction. This does not include new website revisions, but any errors found during the transfer of the site. It is the responsibility of the Client to review the website during this time for any errors and communicate them to Clever. Any errors found after the seven day window or new revisions requested to the site after it is live will require a new project estimate for review/approval.  

Weʼre proud of our work and reserve the right to apply the text “Designed by Clever” on your website footer. Should you wish to remove the credit, a fee of $250 applies. Removal of our name does not mean surrendering our design credit to any other party. Without our expressed consent, you agree that “Designed by Clever” will be visibly displayed on your website acknowledging design credit.

All branding contracts include a set number of concepts and revisions outlined in the initial estimate. Any additional concepts or revisions outside the agreed upon number will be billed at the hourly rate of $65/hour at a minimum of one quarter hour increments. 

Upon completion of the project and full payment of all invoices, all ownership rights transfers to the Client including artwork, designs, copy, photography and websites created by Clever. Clever shall not use or sell these rights to any third party. Clever reserves the right to include any work created for the Client in its own marketing efforts.  

Clever will do everything possible to build you an amazing product, but we accept no liability
for your sales, revenue, and/or the success of your website/business directly, indirectly, or consequentially.

Any project that is stalled for 30 days or more through no fault of Clever will be billed the second half for payment. Any project that is stalled for 90 days through no fault of Clever and has completed final payment will require a new project estimate in order to resume work. 

Either party may cancel this agreement upon 30 days written notice.

In the event of cancellation of this assignment, ownership of all copyrights and the original artwork shall be retained by Clever, and a cancellation fee for work completed, and expenses already incurred, shall be paid by the Client. Cancellation fee is based on when the project is canceled within the provided project timeline. Any project canceled before the half-way point will result in a $250 cancellation fee and no refund on the half-down payment made. Any project canceled after the half-way point will result in 50% of the remaining balance on the project and no refund on the half-down payment made.

Clever will bill the initial half down payment to commence work on the proJect. Half down invoice is due upon receipt and is non-refundable. Second half will be billed upon completion of the project and final delivery of files. Second half invoices are billed at net 30 days.
